EU-Safety Regulation for sunbeds. Should Ireland take it over?

Sadly and surprisingly not many knows about the European sunbed regulations in Ireland and as this regulation has not been introduced to the Emerald island, sunbed users has no benchmark between ''regular'' sunbeds and European Safety Regulated sunbeds, even though the difference is huge. But what does it really mean if the sunbed you use is EU-Safety regulated and what is the exact regulation every European country should follow to protect and provide people with a safe environment during their tanning session, we will go through everything in this blog with you.

UV Limits of the World

The European Union already has the strictest limits on UV irradiance in the world.

Newest UV appliances are limited to 0.3 W/m2 since July 2007.

With the EU-Safety regulation ESA and the EU-policy makers ensuring the highest possible level of safety

ESA cooperated with EU policy-makers to promote fast adoption and implementation of the 0.3W/m2 limit on UV radiation emitted from sunbeds which the EU adopted as mandatory standard in 2007 (EN 60335-2-27). Under this standard, a sunbed session shall have a maximum UV output that corresponds to the mid-day Mediterranean sun (UV index of 12) to avoid any risk of burns and to reduce the likelihood of accident due to long exposure.

This engagement continues today, as ESA  actively participates in preliminary work initiated by the European Commission to reassess standards and its coherence with the objectives defined in the Low Voltage Directive (2014/35/EU).

ESA has also taken several initiatives of its own to ensure tanning services in comply with EU legislation:

*ESA has developed a European Code of Conduct for tanning services, as well as training materials for tanning studios.

*ESA also organises information seminars and trainings in cooperation with national associations in the Member States, including via an e-learning platform.

*In November 2016, ESA released its Industry Commitment to responsible indoor tanning in the EU, which stresses the sector’s willingness to promote cooperation with regulators and supports the highest possible level of consumer safety.

European Standard EN16489: who are involved?

In 2012, the European Sunlight Association started a major initiative by developing a new European Standard on training for and service provision by sunbed operators, in cooperation with CENELEC (one of the main European standardization bodies) and the Austrian Standards Institute (ASI). This work took three years and was carried out jointly with stakeholders such as the European Cancer Leagues (ECL) and the European Association for the Co-ordination of Consumer Representation in Standardisation (ANEC). The standard (EN 16489) was approved in 2014 and ESA together with its members is currently working to implement it across the EU. This would be greatly helped if governments or the EU decided to make it mandatory or at least reference it in any regulation of sunbeds.

Not only our beds complies with the EU-Safety Regulations but the training we carry out as well -The Training and Services Standard consists of three parts:

1.Requirements with regard to the provision of training: it specifies the learning contents essential for the training of persons working for a professional indoor tanning facility and giving information and advice on UV exposure to customers (called “indoor UV exposure consultants”), as well as the procedures of how their qualification shall be provided and assessed.

2.Required qualification and competence: it sets out the requirements which are essential for the knowledge and skills, competence, and qualification of indoor UV exposure consultants.

3.Requirements for the provision of services: it defines the requirements for and assessment of the services provided by professional indoor UV exposure facilities, and contributes to further strengthening consumer protection and safety with regard indoor tanning services.

ESA has also developed a certification, training & labelling scheme for this new standard in cooperation with ASI to facilitate its national implementation. A pilot project was recently launched in the United Kingdom and is ongoing. More countries should follow in the future.

What was the objective of this joint action by Member States?The main objective was to verify that new sunbeds and sunbeds offered for use in services (e.g. tanning studios) are safe, especially with regard to the levels of UV radiation, and the availability of instructions for safe use. It was also an opportunity for surveillance authorities to highlight to suppliers and service providers their obligations to ensure the safety of consumers using their products. This action, which started in September 2008, was co-financed by the Commission under the Consumer Policy Programme (2007­-13).

Who participated?

Participants were market surveillance organisations from ten Member States; Belgium, Cyprus, the Czech Republic, Denmark, Finland, Germany, Hungary, Latvia, the Netherlands and Poland. The joint action was coordinated by PROSAFE, an informal network of European market surveillance officials and was led by the Netherlands

With respect to the safety of sunbeds there is a combination of rules which are as follows:

* The European safety framework covering sunbeds is based on the Low Voltage Directive (LVD) and European Standard EN 60335-2-27 , Regulation 765/2008/EC and the General Product Safety Directive

* In accordance with the provisions of the Low Voltage Directive, products (when placed on the EU market) shall be manufactured in accordance with good engineering practice in safety matters. European harmonised standards (which are voluntary), provide a presumption of conformity with the essential safety requirements of LVD. Recently, EN 60335-2-27:2003, which is the European standard applicable to sunbeds, was amended by the European standardisation body Cenelec, following a mandate issued by the Commission. This amended standard is applicable as of 1 April 2009 and imposes the limits for UV radiation (see below).

* Furthermore, with the coming into force of Regulation 765/2008/EC on 1 January 2010, Member States must take measures against non-complying or dangerous sunbeds, regardless of whether they are operated by consumers or by a service provider.

What is 0.3W/m2 tanning in nutshell?

The maximum irradiance level of 0.3W/m2 effectively ensures the UV output of a tanning bed is comparable to that of the mid-day Mediterranean sun. Emissions over this level throughout Europe are now deemed “unsafe”. Be mindful -> there are some misinformed operators, who simply put “0.3” lamps in their beds and marketed their beds as compliant, when this simply isn’t the case. Filters, lamps, ballasts and embedded software all play a part in making the bed 0.3 compliant.

What you can expect from 0.3W/m2 tanning?

Tanning sessions in sunbed salons using appliances that comply with European Standard BS EN 60335-2-27 are much safer and greatly reducing the risk of burns. Reducing the output power of 0.8W/m2 to 0.3W/m2 means that tanning will obviously take longer, but it also gives sunbed user more control over how ones tan is going to look like in the end and makes it last noticeably longer without any orange shade.

“UV exposure on a tanning bed is equivalent to 15 times that of the Mediterranean mid-day sun” was one of the commonly used mantras – well, not anymore! :)
